Some options are legal nationwide. Spravato (esketamine) is FDA-approved and given in certified clinics, and licensed clinicians can prescribe ketamine. Other psychedelics, such as psilocybin, are only legal where a state has created a regulated program. Same Team only helps you navigate legal, state-authorized treatments.
Oregon and Colorado both allow supervised psilocybin services through state-licensed programs: Oregon after voters passed Measure 109 in 2020, and Colorado after voters passed Proposition 122 in 2022. Other states are likely to follow — New Mexico passed a medical psilocybin law in 2025, and more states are considering similar legislation. Psilocybin remains illegal under federal law and in most states.
Spravato is a nasal spray made from esketamine, a form of ketamine. It is FDA-approved for treatment-resistant depression and for depression with acute suicidal thoughts, and must be given in a certified clinic with at least two hours of monitoring afterward. Other ketamine treatments, such as IV infusions, are prescribed by clinicians off-label and are usually paid out of pocket.
